California Landlords: New Law, AB 2801, Enforces Photo Requirements for Security Deposit Deductions
If you’re a landlord or property manager in California, there’s a new rule to know about.
Starting April 1, 2025, you’ll be required to take photos of your rental property at three key points:
• When the tenant moves out, before any cleaning or repairs
• After cleaning or repairs are completed
• And for any new tenancy beginning July 1, 2025 or later, just before move-in
If you plan to deduct anything from the security deposit, you’ll also need to include these photos with the itemized statement and a written explanation of the charges. Photos can be shared by mail, email, flash drive, or a link to view them online.
This new law, AB 2801, is designed to reduce confusion and prevent disputes by documenting the condition of the unit at every stage.
It also reiterates that tenants cannot be charged for professional cleaning unless it’s reasonably necessary to return the property to the condition it was in at the beginning of the lease.
If you’re already in the habit of taking photos, you’re on the right track. As of next year, it just becomes part of the legal process.
